1- Usage Systems and Service Terms:

  1. INBTKW.org is an electronic public platform aiming to develop and enhance public service to improve the intellectual and social status of our country through positive exchange of thought.  It helps users suggest common solutions that can be adopted by government and civilian establishments with the purpose of reforming and developing the nation through society participation.

  2. Nevertheless, this free platform brings responsibility to make this participation valuable, so it might contain comments, forums and interactive discussion platforms.

    The user shall take responsibility of the content that he/she uploads on the website, as well as his/her interactive discussions whether through a interaction or a comment or uploaded materials on this electronic forum. Any participation shows that the user is 18 years old or older, and if the user is younger than 18 years and is a minor then he/she must has a legal approval by the parents or the legal guardian in order to access and participate in INBTKW.org. The user is obligated to stipulate commitments of service terms, which forms a binding contract between you and INBTKW.org.
     
  3. Legal Instructions:

    By participatiNG in INBTKW.org, you shall accept commitment of the following behavior rules:

    • Not uploading, sharing nor transferring any user content that breaches or violates, in any way or form, others' rights, including any data that might result in discredit or a pursuit or threat to others.
    • Not uploading, sharing nor transferring any user content that might offend society, including flagrant expression, extremism, racism, vulgarity, impudence and profanity.
    • Not uploading, sharing nor transferring any data that might contain, or promotes or have any hints to pornography.  Agreeing to abstain from uploading, posting or copying any material that might contain or promote pornography, pedophilia, incest, bestiality or any other obscenities.
    • Not uploading, sharing nor transferring any user content that violates any law or promotes an activity that forms a criminal offense or results in civilian charges. 
    • Not uploading, sharing nor transferring any user content that calls for or provides instructions to illegal activity or promotes illegitimate activity. 
    • Not uploading, sharing, nor transferring any data that might contain commercial advertisements or any request of products or services without previous explicit permission from INBTKW.org.
    • Not uploading, sharing nor transferring any user content not generally related to a specific subject or subject of certain discussion. 
    • Not participating in any form of false impersonation of person or entity including, but not limited to, any employee of INBTKW.org, or any fictitious claim or false affiliation. 
    • Not to interfere in the privacy of any other user, including collecting personal data in order to know the identity of users of INBTKW.org or sharing personal data through a third party.
    • Not uploading, sharing nor transferring user’s corrupt content or viruses or other harmful or destructive contents. 
    • Not to interfere in, or corrupt INBTKW.org or any associated networks, nor deny any requirements, procedures, policies, or regulations of networks connected to this website.  
    • Not uploading e-mail addresses nor undesired or unauthorized activity or promotions advertisements like 'spam/junk e-mails', 'the disturbing advertisement ', 'series of messages', 'pyramidal plans' or any other form of promotions.
    • Not to reproduce, repeat, copy, sell, resell nor use any part of INBTKW.org for the sake of commercial reasons.
    • Not uploading nor sharing any user content which is protected by Patent Law, trademarks, commercial confidentialities, right of publicity or other patent laws without explicit permission of the owner to publish such trademarks. You shall be responsible of any damage resulted from any violation of patent and publication rights, trademarks, commercial confidentialities, publicity rights and other property rights or any damage resulted from such matters. Any person has been determined by INBTKW.org to violate patent properties right or others' rights will be blocked frojm submitting or sharing any other material on INBTKW.org.
    • If necessary, a complaint will be submitted against you due to your exploitation of a content, name, or affliation, and such complaint will be submitted by the platform or by any way INBTKW.org finds appropriate.
    • In accordance to what INBTKW.org finds fit, any behavior might restrict or ban other users to enjoy INBTKW.org; the orginization has the right to remove or edit the content and cancel your account for any other reason. INBTKW.org is not responsible for user's content uploaded to INBTKW.org or any posted comments in comment zones, chat rooms, advertisements, or any other interactive activities by INBTKW.org users.

    D) Censorship 

    •  INBTKW.org has the right to, and is not liable to, detect users’ shared or uploaded content on INBTKW.org to determine conformability with service terms and operational rules stipulated by INBTKW.org. However, it doesn't have any direct commitment to detect, edit and remove any user content uploaded or shared in the website. INBTKW.org has the full and absolute right on how to conduct the website, and can refuse to upload or share any content on INBTKW.org without notifying the member at any time and for any reason. The user is solely responsible in making alternate copies of the content and replacing any content. 

    E) User's content license:

    • Through submitting user's content in INBTKW.org, you automatically give the right and license to use, share, copy, edit, adjust, translate, establish derivated works from the material, include it in different works, distribute it without license and use user content (entirely or partially) globally and by any way whether mass media or known technology or develop it subsequently once the full round of any patent and copy rights which might existed have expired; and you guarantee that the said content is accurate and not misleading and using, sharing and transferring user's content by such way is neither violating any of  these service terms nor will violate any rights as well as not causing damage/harm to any person or entity.

2- Copyrights and property:

INBTKW.org contains material subject to copyrights, trademarks and other confidential information, including but not limited to, the copyrights and posting rights for texts, programs, photos, videos, drawings, music, sounds and the whole content of INBTKW.org generally abides by the laws of the State of Kuwait and copyright laws thereof. INBTKW.org has the author's right to choose, arrange, coordinate, enhance such content, as well as the original content.  Therefore, you don't have the right to edit or post or copy or establish derived works – or any way of use- of any partial or entire content.  You can download copywrited material for personal use only, as is explicitly allowed to by the patent law. Without explicit permission from INBTKW.org and the owner of the copyright, uploaded material will not be allowed to be used, copied, redistributed, resent, posted or used for commercial purposes. If permission to redistribute, copy, or post copyrights were granted and works were not properly sourced, like omitting or incorrectly stating the writter’s name, trademarks, lines, or copyrights, you acknowledge that you don't have the right to use any of the copyrighted material.

3 - Third Party's Content:

INBTKW.org is the distributer (and not the publisher) of the content submitted by third parties. Providing consulting, data, services and offers, or other information and content provided by third party, including information providers or people benefiting from INBTKW.org, is the responsibility of the author/authors, and publisher/publishers and not INBTKW.org.

Neither INBTKW.org nor any other third party guarantees accuracy or full information, as well as the benefit of any content, nor its popularity or reasoning   (see section 5 below complete terms that govern limitations of commitments and assignments). In many cases, the available content of INBTKW.org represents the opinions and decisions of every user or information provider and not by virtue of a contract with the platform, where INBTKW.org doesn't support nor is responsible for accuracy or reliability of any piece of advice or opinion made by a person in INBTKW.org by himself or third party. Under any circumstances INBTKW.org will not be liable to any damage or loss caused by use or reliance of information provided in INBTKW.or.  The website is not responsible for any work or refusal of work from your side based on information of INBTKW.org and it is your responsibility to evaluate the accuracy or fullness or importance of any information or opinion or advice or consultation or content available in INBTKW.org. 4-  Advertisements and Promotions:
Currently, there is no intention to operate any advertisements on the platform, but in the future INBTKW.org might present advertisements and promotions for third parties on the website. Therefore, your wor, deals, participation, promotions or any other advertisers' activities through INBTKW.org or terms or guarantees or representations related to such deals, whether commercial or non commercial, shall be between only you and third party.  INBTKW.org is not liable to any loss or damage of any kind you suffered from due to such deals or due to existence of the third party of the advertisers on the website.

5-  Disclaimer of warranty and defining responsibility:

  1. You clearly acknowledge that usage of INBTKW.org platform is your own responsibility. Neither INBTKW.org nor its employees –i.e. agents, outer content providers, nor their licensees- guarantee that the website will not be unconnected or free of errors, as well as it doesn't provide any guarantees for results that can be gained by using INBTKW.org and no guarantees are provided regarding the outcome of using INBTKW.org, or regarding accuracy and effectiveness of any piece of information or service.
  2. INBTKW.org offers, including but not limited to, users to download any content without providing any guarantees, whether stated or implied, including but not limited to, copyrights guarantees, or implied guarantees for your marketing or fitting a specific purpose.  Exceptions are guarantees that are included by the company, which cannot be edited or excluded by virtue of Kuwaiti Laws that apply to these service terms.

  3. INBTKW.org, its employees, agents, outer content provider, and licensees are not responsible for liable of aggressive or illegal behavior of other users or third parties.  Any harm that might arise from above said acts is solely and completely the user’s responsibility.

All of INBTKW.org, its employees, agents, outer content provider, licensees, and any entity participating in establishing or sharing INBTKW.org content, are not responsible for any harms including but not limited to direct/indirect damages nor accidental damages nor special or consequential or disciplinary damages that might arise from using or inability to use INBTKW.org.

In addition to the aforesaid terms, All of INBTKW.org, its employees, agents, outer content provider, licensees, and information providers participating in establishing or sharing INBTKW.org content, are not responsible for, regardless of timeframe, any mistakes or inaccurate information or deleting or other information defects on INBTKW.org or any delay or discontinuity in transferring such information, or for any claims or losses caused or arised from such reasons. None of the previously mentioned parties shall be responsible for any third parties' claims for any losses of any kind, including but not limited to, the losses of profits and any penal or consequential compensations

In addition to this, there are no guarantees for the results following from using such information.
  7. INBTKW.org is not responsible in any way for unauthorized log in or usage of your personal information. By accessing to INBTKW.org you acknowledge and agree that INBTKW.org is not responsible for any form of unauthorized usage of your account. In case you do not agree, you should not use INBTKW.org.
    1. Written or electronic power of attorney to act on behalf an alleged violated copyright of exclusive owner.
    2. Explanation of the author's work and a proof that the copyrights have been violated, which can include many copyrights on one website by one notification, with the proof of sharing such works on the concerned website.
    3. List of the materials that were violated and that are required to be deleted or reviewed in order to be suspended, and enough information enable us to identify the material/s.
    4. Enough information to allow us to contact the complainant.
    5. A declaration shows that the accused person believes with good intention that the way he used materials is not allowed by the copyrighter or his agent.
    6. A declaration that the information mentioned in the notification is correct, subject to liability, and that the complainant shall be authorized to act on behalf of the exclusive owner of alleged violated copyrights. 

6- Compensation:
You agree to waive any compensation claims for damage from INBTKW.org, its managers, employees, and agents and for all claims and expenses including attorney fees resulting from your usage or through your personal account in INBTKW.org.

7- Service Termination:
INBTKW.org might terminate or suspend these service terms at any time without noticing you previously. Without specifying the aforementioned, INBTKW.org has the right, according to its own consideration, to terminate your account immediately in case of any unacceptable behavior from your side, or in case you violated theses service terms.

8- Trademarks:
INBTKW.org platform has the full rights for all logos and trademarks used in communication with the website. All other logos and trademarks that appear on the website belong to their owners.

9- Varieties:
These service terms and any operating rules on INBTKW.org which were set by the company shall form the complete agreement of the parties regarding subject of this law and shall nullify and prevail all previous verbal or written agreements between the two parties regarding a subject similar to this. The provisions of service terms are for benefit of INBTKW.org and third parties of service and license providers; and each party shall have the right to confirm and enforce these provisions immediately. These service terms shall be interpreted according to Kuwaiti Laws without any consideration for any conflict of laws.  Any disclaimer from any party is considered a violation and neglect. Addresses section used here whether of platform or its providers or of subscribers is not about to be included in any legal procedures.

10- Author's & Publishing Copyrights:
INBTKW.org respects all copyrights, therefore it relies on and carries out the policy that stipulates termination of   service in appropriate circumstances of users and accounts of owners who violate copyrights.
